POLICY ON THE PROTECTION OF CANDIDATES' PERSONAL DATA
AUTOSTAR takes privacy and the protection of personal data seriously.
We are therefore committed to implementing appropriate measures to ensure the protection, confidentiality, and security of your personal data and to processing and using such data in accordance with applicable regulations, in particular European Regulation 2016/679 of April 27, 2016 (GDPR) and Law No. 78-17 of January 6, 1978, known as the Data Protection Act.
- Scope of this policy
This policy applies to all processing of personal data carried out by AUTOSTAR in its capacity as Data Controller under applicable regulations, with respect to candidates who submit unsolicited applications or respond to existing job postings.
- The data collected, for what purposes, and on what legal basis
- Data Collected :
- Identification and contact details (last name, first name, email address, address, phone number),
- Resume, educational and professional background,
- Cover letter,
- Interests,
- Any information we collect during interviews related to the recruitment process,
- Any information you voluntarily provide to us as part of the recruitment process.
This data is either collected directly from you or provided to us by third parties, including recruitment service providers or references you have provided to us during the recruitment process.
- Purposes of Data Collection :
The information collected is processed for the following purposes:
- To review your application so that we can determine whether it is a good fit for the position you applied for or any other position at AUTOSTAR,
- More generally, to manage the recruitment process and contact you to arrange interviews.
- Unless you object, we may contact you in the future if opportunities arise at AUTOSTAR that might be a good fit for you.
- Legal Basis :
This processing is, in part, necessary for the performance of pre-contractual procedures—namely, to review your application and determine whether we wish to enter into an employment contract with you—and, in part, based on our company’s legitimate interest when we retain your application to contact you again should an opportunity arise that matches your profile. This processing thus helps optimize AUTOSTAR’s recruitment processes and therefore benefits both candidates and AUTOSTAR.
- How long we keep your data
We retain your data for as long as necessary to fulfill the purposes for which we collected and processed it (see point 2).
If your application is successful and you join AUTOSTAR, your data will be retained for the duration of your employment with AUTOSTAR (the term of your employment contract) and for the applicable statute of limitations period, after which it will be deleted (5 years after your departure).
If your application is not successful, your data will be kept for a period of 6 months, after which it will be deleted.
- Access and disclosure of your data
Your data is accessible internally only to the departments that need access to it for the purposes mentioned in section 2: the Human Resources department and the internal department associated with the position for which you applied.
Your personal data may also be shared with:
- Public authorities when required by law,
- French or foreign authorities, in response to any type of legal or administrative proceedings or law enforcement measures requested by the competent authorities.
We may also need to work with service providers acting as subcontractors to perform services related to the data processing we carry out. These service providers are involved, in particular, in hosting, data processing, database management, and IT maintenance services. These service providers act solely on the instructions of AUTOSTAR and will be subject to the same security and confidentiality obligations as AUTOSTAR.
- Protection and security of your personal data
AUTOSTAR is committed to taking all reasonable and appropriate organizational and technical measures to prevent any disclosure, use, alteration, loss, or destruction of the personal data provided by an applicant.
- Your rights
In accordance with applicable regulations, you have the following rights regarding your personal data:
- Right to information,
- Right of access to personal data that we process,
- Right to rectification,
- Right to erasure,
- Right to restriction of processing,
- Right to object to the processing of your data when the processing is based on a legitimate interest of AUTOSTAR (see point 2),
- Right to data portability,
- Right to send us specific instructions regarding the fate of your personal data after your death,
- Right to lodge a complaint with the CNIL.
